testimony of investigator for the California Department of Health Services,
or refer at trial to a draft preliminary report the investigator prepared
for the Department, when the investigator relied substantially on hospital
peer review committee records in forming his opinions.

A contract for a public project does not create a general duty to third
persons giving rise to negligence liability,
with respect to an allegedly
dangerous condition the contract work may correct, if the requirements for
application of Restatement Second of Torts, Section 324A, also known as the
Good Samaritan rule, are not otherwise satisfied.
