F & H CONSTR. v. ITT HARTFORD INS. CO. OF THE MIDWEST, No C042707 (Cal.
3d App. Dist. May 05, 2004)

The insured delivered subgrade materials to plaintiff, and plaintiff
used those materials in construction project before discovering the
defect. This did not constitute "property damage" within the meaning of
the applicable insurance policy, and summary judgment in favor of
insurance company was proper.

ENVIRONMENTAL LAW, GOVERNMENT LAW
CITY OF LODI v. RANDTRON, No C037445, C038921 (Cal. 3d App. Dist. May
05, 2004)

An administrative abatement action order issued pursuant to the
Comprehensive Municipal Environmental Response and Liability Ordinance
is preempted by the state Hazardous Substance Account Act because the
City is a site listed by the Department of Toxic Substances Control for
which the state has exclusive jurisdiction over all remedial response
actions.
