Defendants were not contractually bound to pay $14 million in
attorney fees where reasonable attorney fees were $8 million.
Summary judgment for defendants is affirmed.

CAVANAGH v. CALIFORNIA UNEMPLOYMENT INS. APPEALS BD., No. C042172
(Cal. 3d App. Dist. March 30, 2004)

Trial court properly denied plaintiff's petition for a writ of
mandate to prevent the Employment Development Department from taking
further action against him to collect unpaid unemployment insurance
contributions and other taxes owed by his insolvent business. The
assessments did not violate the automatic stay under then-effective
version of the bankruptcy code, and the insurance code barred the
court from issuing the writ of mandate enjoining the Department from
collecting the contribution.

PEOPLE v. ARATA, No. C042769 (Cal. 3d App. Dist. April 29, 2004)

Defendant is entitled to credit against his state prison term for
the actually served custody credits and conduct credits that accrued
to him; trial court lacked authority to impose an $800 restitution
fine per Penal Code section 1202.4 when it had already imposed a
$600 fine at the time defendant was granted probation.
