COUNTY (JEONG),
No B155736 (Cal. 2d App. Dist. March 31, 2004)
Code of Civil Procedure section 354.6, which allows certain individuals
who were forced labor victims during World War II to recover
compensation for unpaid labor and personal injuries, is
unconstitutional. By encouraging coercive litigation of claims against
Japanese nationals, it conflicts with the federal policy of diplomacy
embodied in the Treaty of Peace.
