AUTOS, INJURY AND TORT LAW, INSURANCE LAW
MERCURY INS. CO. v. AYALA, No. B165390 (Cal. 2d App. Dist.
March 17,
2004)
The loss of consortium suffered by the spouse of a woman injured in
an auto accident does not trigger her "per-accident" (as opposed to
the lower, "per-person") uninsured motorist policy coverage.
Judgment for plaintiff is affirmed.

CIVIL PROCEDURE, COMMERCIAL LAW, COMMUNICATIONS LAW
WEST CORP. v. SUPERIOR COURT OF SAN DIEGO COUNTY
(SANFORD), No.
D042633 (Cal. 4th App. Dist. March 17, 2004)
California may assert personal jurisdiction over a nonresident
telemarketing corporation when a California resident initiates a
phone call to buy a product, reaches a telemarketer who handles the
order, and the telemarketer then initiates a sale of a separate
product and allegedly makes misrepresentations during the sales
pitch for the separate product.

CRIMINAL LAW & PROCEDURE
PEOPLE v. MORSE, No. A101894 (Cal. 1st App. Dist. March
05, 2004)
One can be convicted under Penal Code section 453 for having an
incentiary device with an intent to torch one's own property; the
statute does not require an intent to affect the property of
another.

CRIMINAL LAW & PROCEDURE, HABEAS CORPUS
PEOPLE v. SUPERIOR COURT OF LOS ANGELES COUNTY (GERMAN), No. B170313
(Cal. 2d App. Dist. March 17, 2004)
Because the six-year statute of limitations had not yet expired when
Penal Code section 803(g) was enacted, that statute extended the
limitations period, allowing for prosecution to be commenced within
one year of the victim's police report. Application of the statute
did not violate the ex post facto clause here.

PROPERTY LAW & REAL ESTATE
KAPNER v. MEADOWLARK RANCH ASS'N, No. B163525 (Cal. 2d
App. Dist.
March 17, 2004)
Plaintiff has not acquired a prescriptive easement over the areas
that he enclosed and took possession of by his improvements. The law
does not allow parties who have possessed land to ignore the
statutory requirement for paying taxes by claiming a prescriptive
easement.
