CIVIL PROCEDURE, UNFAIR COMPETITION LAW

PEOPLE EX REL. LOCKYER v. BRAR, No. G033116 (Cal. 4th App. Dist.

February 24, 2004)
This appeal from the decision denying plaintiff's anti-SLAPP claim
is dismissed as patently frivolous. The anti-SLAPP statute
specifically exempts the Attorney General's efforts to make
defendant stop filing lawsuits under California's unfair competition
law.

CRIMINAL LAW & PROCEDURE, EVIDENCE

PEOPLE v. SEIJAS, No. B160209 (Cal. 2d App. Dist. February 24, 2004)
Defendant's conviction is reversed because the trial court committed
prejudicial error in allowing the prosecution to introduce the
critical preliminary hearing testimony of a witness erroneously
found to be unavailable.

FAMILY LAW

RITCHIE v. KONRAD, No. B159689 (Cal. 2d App. Dist. February 24,
2004)

When considering a request to renew a domestic violence protective
order, a trial court should grant the requested extension unless the
request is contested and the judge determines the protected party
does not entertain a reasonable apprehension of future abusive
conduct.

INJURY AND TORT LAW, INSURANCE LAW, LABOR & EMPLOYMENT LAW, WORKERS'
COMPENSATION

ROTH v. L.A. DOOR CO., No. G031221 (Cal. 4th App. Dist. January 23,
2004)

Plaintiff's employer, as an authorized self-insurer for the purpose
of providing workers' compensation insurance, is deemed an "insurer"
providing "other insurance" within the meaning of Insurance Code
section 1063.1(c)(9). Thus its claim is excluded as a "covered
claim" and the California Insurance Guarantee Association is not
responsible for amounts it paid to the plaintiff in workers'
compensation benefits.

INSURANCE LAW

AM. CONTRACTORS INDEMNITY CO. v. SALADINO, No. B158573 (Cal. 2d App.
Dist. February 24, 2004)

The court did not err in denying the sureties' request to impose a
lien and for a constructive trust on the funds the special
administrator of decedent's estate delivered to the public
administrator appointed to succeed her.
