Despite plaintiff's considerable procedural error, the new
defendants waived any objection to their joinder by filing answers
and thereby making a general appearance. Their waiver was effective
even though they had no reason to suspect, at the time, that they
had not been properly joined.

PEOPLE v. POWELL, No. B168083 (Cal. 2d App. Dist. January 08, 2004)
Counsel may waive jury trial over the objection of his or her client
in a "not guilty by reason of insanity" commitment extension trial.
Because extension trials are civil in nature and directed to
treatment, not punishment, the constitutional right to personal
waiver of jury trial does not apply.

The conclusory testimony of plaintiff's expert was inadmissible
under Evidence Code section 801 because it could not assist the jury
to determine whether it was more probable than not that the
retention of the retractor in plaintiff's abdomen contributed to his
abdominal infection.
