SHEYKO v. SAENZ, No. c039132 (Cal. 3d App. Dist. October 09, 2003)
In a case involving regulations issued by the California Department
of Social Services implementing the Statewide Fingerprint Imaging
System, Welf. & Inst. Code, section 10830, the trial court's writ of
mandate in favor of the plaintiff is reversed where the plaintiff
failed to show the Department's regulations exceed statutory
authority.

PEOPLE v. GUTIERREZ, No. G031028 (Cal. 4th App. Dist. October 10,
2003)
Convictions for attempted murder and assault with a firearm are
affirmed where 1)the court had no sua sponte duty to instruct on
attempted voluntary manslaughter, 2)pointing a gun was sufficient
evidence to convict on assault, 3)defendant was not denied effective
assistance of counsel and 4) the abstract of judgment did not need
to be corrected to reflect a probation violation instead of a drug
offense.

2003)
In a drug possession and driving under the influence case, the
district court properly found the defendant ineligible to be
sentenced pursuant to the Substance Abuse and Crime Prevention Act
of 2000 (Prop. 36) where the defendant's violation of Vehicle Code
section 23152(b) excluded him from Prop. 36 treatment.

In an action alleging failure to provide adequate security measures,
dismissal is affirmed where a violent criminal assault on a
religious organization was not reasonably foreseeable, and imposing
liability based on vague threats of violence would impose an unfair
burden on the organization.
