Code of Civil Procedure section 437c, a summary judgment statute
that authorizes a court to award "reasonable expenses" as a
sanction, does not allow a court to award, as a sanction, attorney's
fees incurred by the party to whom sanctions will be paid.

Neither California nor federal law recognizes a union member
communication privilege, and Evidence Code section 911 mandates that
courts are not free to create new evidentiary privileges. Trial
court must therefore grant plaintiff's motion to compel answers to
deposition questions.

PEOPLE v. RIVERA, No. G031469, G031642 (Cal. 4th App. Dist. December
29, 2003)
Because Penal Code section 417(b) applies only to proscribed conduct
occurring on the grounds of a day care center or other youth
facility, defendant's felony convictions for exhibiting a loaded
firearm are invalid. Evidence supports a misdemeanor conviction
under section 417(a)(2)(B), however.
